Alliances and Networks

Chimei & Malenya Co. Advocates is deeply committed to advancing justice and upholding human rights through strategic alliances with esteemed organizations, most notably the Kenya Human Rights Commission (KHRC). Our firm is proud to serve as trusted legal counsel for KHRC, representing the Commission in high-stakes litigation and supporting its transformative pro bono legal aid programme. These partnerships reflect our dedication to fostering systemic change, promoting accountability, and ensuring access to justice for all, particularly marginalized and underserved communities.

Our collaboration with KHRC encompasses a diverse portfolio of impactful cases, addressing critical issues ranging from constitutional challenges to reparations for victims of injustice. For instance, we are actively involved in Nairobi Constitutional Petition 232 of 2019: KHRC & Others vs. Hon. Attorney General & Others, where we represent KHRC and other NGOs in challenging the National Budget process for the Financial Year 2019/2020. This case contests the failure to enact the Division of Revenue Bill 2019, which threatened to disrupt funding for counties, highlighting our commitment to safeguarding equitable resource allocation.

Additionally, we are preparing to institute the Solai Civil Case in the High Court in Nakuru, seeking reparations for victims of the 2018 Solai Dam Tragedy. This case underscores our dedication to securing justice for those affected by corporate negligence. Similarly, in Naivasha Cr 977 of 2018: R vs. Perry Mansukh Kansagara & 8 Others, we hold a watching brief for KHRC on behalf of Solai Dam victims, ensuring their voices are represented in criminal proceedings. We also defend victims in Nakuru Criminal: R vs. Peter Mbae and 8 Others, protecting those facing victimization for advocating for compensation.

Our work extends to other significant cases, such as Nairobi Constitutional Petition 379 of 2017: Katiba Institute vs. The Hon. Attorney General & Others, where we challenge provisions in the National Police Service Act that permit excessive police force, including shoot-to-kill orders. In Kisumu ELRC 146 of 2016: Joram Sire vs. Municipal Council of Kisumu, we advocate for retirees of the defunct Municipal Council of Kisumu, seeking fair compensation for wrongful dismissals. Furthermore, in Migori ELC 792 of 2017: George Chacha vs. Wambua Ghati, we address a boundary dispute among the Kuria community in Migori County, demonstrating our versatility in handling diverse legal matters. Finally, in Constitutional Petition No. 410 of 2010: In Re Rose Owira & Others vs. The AG & Others, we pursue accountability for extra-judicial killings in marginalized communities, advocating for reparations and transparency.

Through these alliances and our robust network, Chimei & Malenya Co. Advocates remains steadfast in its mission to deliver impactful legal representation, champion human rights, and drive meaningful change. Our partnerships enable us to amplify our efforts, ensuring that justice is accessible to all, from grassroots communities to national institutions.
